GDPR – General Data Protection Regulation

Your data and how we use it

The General Data Protection Regulation (GDPR) will apply from 25 May 2018 and it affects how we use your data. The work we carry out at YOUpresent involves holding personal data in compliance with the General Data Protection Regulation (GDPR). The GDPR applies from 25 May 2018 when it replaces the Data Protection Act 1998. This is our Privacy Policy. It tells you how we will use and protect any information we hold about you and outlines your rights under the General Data Protection Regulation.

Our data privacy commitment to you

If we ask you for personal information we will:

  • make sure you know why we need this information
  • only ask for information that we need
  • ensure only those appropriate have access to it
  • store your information securely
  • inform you if the information will be shared with a third party
  • only keep your information for as long as we need to
  • not make it available for commercial use (such as marketing) without your permission
  • ensure you are provided with a copy of data we hold on you, on request this is called a Subject Access Request or SAR
  • ensure there are procedures in place for dealing promptly with any disputes or complaints

In return we ask you to:

  • Give us accurate information
  • Tell us if there are any changes

Why would YOUpresent hold my personal data?

YOUpresent provides presentation software and design services to its customers. We sell software products online, communicate to subscribed users via email and through our blog and contact anyone requesting us to do so via our online contact page. Depending on the type of engagement you have had with YOUpresent, we may store data as described in our Subject Access Request guidance document. We use this data to communicate with you and do not share it with any third parties.

What data does YOUpresent hold?

We hold your data if you have:

  • previously signed up to receive communications from us, or
  • have requested one of our representatives to contact you by emailing us directly, telephoning us or requesting us to contact you by completing our online contact us form.

Personal data is limited to contact details and is listed in our Subject Access Request guidance document.

Where is my data stored?

Your data is may be stored electronically on our internal secure file servers which have restricted access and are not accessible from the Internet. If you filled out and submitted any of our contact or product feedback forms online, this data is stored in the cloud in a secure Google Drive folder which also has restricted access.

How long is my data stored?

We may retain your Personal Data for as long as you continue to use our products and/or website, and thereafter as permitted or required by applicable law or to satisfy our business requirements.

What are my rights? How will YOUpresent protect them?

We are committed to protecting your rights under GDPR.

1.1 Your right to be informed

This document provides you with information in relation to how your data is processed as YOUpresent customer or subscriber. This ensures that we are transparent with you, as an applicant with regards to what we will do with the information you supply to us.

1.2 Your right to access to your personal data held by YOUpresent is known as a Subject Access Request

You have the right to request a copy of the information we hold about you. On receipt of a valid application we will tell you whether we hold any data about you and provide you with a copy. Further information on how to apply can be found here.

1.3 Your right to request information held is accurate. Can I update it?

If you think that the information held by us at YOUpresent is incorrect, you have the right to request it is corrected. If you challenge the accuracy of data that was provided to us by a third party, for example our e-commerce provider, we will send your request for correction to that party for their consideration. It is the duty of both you and the organisation who submitted your data to ensure that the information you have submitted is accurate. If you believe you have submitted an error you may contact us to request it to be changed.

2.1 Your right to request erasure of your personal data

You have a right to have personal data held about you erased. At the YOUpresent we will only do this if certain criteria are met such as proving your identity to us.

2.2 Your right to prevent YOUpresent from processing your information which is likely to cause you damage or distress

You have the right to request restriction of processing where it has been established that one of the following applies:

  • the accuracy of personal data is contested, during the period of rectification
  • where processing is unlawful
  • where an individual has requested it is retained to enable them to establish, exercise or defend legal claims.
  • pending verification of the outcome of the right to object
  • where processing has been restricted

YOUpresent customers can request restriction of processing for any of the above reasons until these are resolved. Should you wish to restrict processing you will need to call us on +1(952)-856-3806. Any requests to stop processing will be considered on a case-by-case basis.

2.3 Right to receive an electronic copy of any information you have consented to be supplied to us known as data portability

You have the right, where this is technically feasible, to electronically receive any personal data you have provided to YOUpresent to process, on a consent basis.

3.1 You have the right to object to processing of your information

YOUpresent does not currently undertake any data processing activities.

4.1 You have the right to make a complaint to YOUpresent and the ICO

If you wish to make a complaint to us regarding the way in which we have processed your personal data you can make a complaint to the Data Protection officer via the contact details in this policy.

Transfer outside the European Economic Area

If any of your data has to be transferred outside of the UK YOUpresent will ensure that an adequate level of protection is put in place.

Who is the data controller?

A data controller decides the purposes for which and the manner in which any personal data is processed. YOUpresent is the data controller of information held by us for the purposes of GDPR. We have the responsibility for the safety and security of all the data we hold.

Who are the data processors?

A data processor is anyone (other than an employee of a data controller) who processes that data on behalf of the controller.

The personal data we store is used solely to communicate with our customers and subscribers. YOUpresent does not process data nor subcontract the processing of data to third parties. Payment data entered during an online purchase is managed exclusively by our e-commerce provider Shareit (a Digital River company) who publish and maintain their own GDPR compliance policies and procedures. Payment data is not provided to YOUpresent by Shareit. We receive payment confirmation information from Shareit on successful completion of a purchase which includes the name and postal address of the purchasing licensee.
